1. Using Paint Session
These terms apply to the Paint Session app provided by Tyche Ventures LLC. By using the app, you agree to these terms, subject to applicable law. If you do not agree, stop using it. Paint Session is an organizational notebook for painting projects, not a professional instruction, appraisal, inventory valuation or safety service.
2. License and Apple terms
Use of the app is subject to the applicable license and usage rules presented by Apple. The Apple Standard End User License Agreement applies when no custom license is supplied through the App Store. These app-specific terms supplement, and do not expand or override, the applicable Apple license or non-waivable consumer rights. They do not permit copying, resale, redistribution or modification of the app beyond what the license and law allow.
3. Your artwork and references
You retain your rights in artwork, photographs, notes and other content you add. These terms do not transfer ownership of your work to Tyche Ventures. You are responsible for having the permissions needed to use and share reference images, other people's artwork or personal information. Do not use the app or its exports to infringe others' rights or for an unlawful purpose.
Built-in template text, example images and the app's original software and design are provided for their intended use in the app. An example is not evidence of a customer's work, a promise of a result or a claim that a completed piece was made by you.
4. Painting guidance and materials
Templates and documentation prompts are editable suggestions. They are not mandatory instructions, verified material recipes, safety recommendations or guarantees of artistic results. Follow product labels, manufacturer instructions and appropriate professional guidance for paints, solvents, tools, ventilation, drying, cure and finishing. The app does not verify physical drying or material compatibility. Children using art materials should have suitable adult supervision.
5. Local records, exports and backups
Projects and templates are stored locally. There is no Paint Session cloud account, automatic sync or developer-operated recovery service. You are responsible for protecting your device and maintaining backups of important work. A PDF is a read-only report; an editable project backup is separate and does not include the entire My Templates collection. Individual templates have their own editable backups. Recently Deleted is local recovery, not an off-device backup; confirmed permanent deletion cannot be undone in the app.
App deletion, device failure or use of incompatible older builds can affect access to local work. Files you share may contain full notes, photos and metadata. Check their contents and destination. 6. Availability and payment
Paint Session's launch offer is a one-time paid App Store purchase with all current features included, not a subscription or in-app purchase. The applicable price, taxes, availability, purchase eligibility and usage rights are presented by Apple before purchase. Apple processes payments and handles refund requests under its policies and applicable law. App purchase does not waive disclosed storage limits or guarantee every possible future feature. TestFlight access is governed by Apple's testing service and does not establish a paid App Store entitlement.
7. Support and third parties
Tyche Ventures LLC, not Apple, provides app support as required by applicable law. Contact support@tycheventuresllc.com. Response times may vary. Apple, email providers, file destinations and printing services operate under their own applicable terms. We do not control their availability or whether a recipient retains an exported copy.
8. Disclaimers and responsibility
To the extent permitted by applicable law, the app is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free records or fitness for a particular artistic or business purpose. We do not guarantee an artistic outcome, sale, accurate valuation or recovery of lost data. These limitations do not exclude warranties, remedies or responsibilities that cannot legally be excluded.
To the maximum extent permitted by applicable law, Tyche Ventures LLC is not liable for indirect, incidental, consequential or special losses, including loss of profit or data, arising from use or inability to use the app. Where a liability limit is lawful, aggregate liability is limited to the amount paid to us for the app during the preceding 12 months or US$50, whichever is greater. Nothing limits liability where prohibited by law, including applicable rights for fraud, willful misconduct or non-waivable consumer protections.
9. Changes, ending use and applicable law
You can stop using the app at any time. Keep any backups you need before removing it. A material breach may end your license as provided by the applicable license and law; Paint Session does not use a Tyche account that can remotely delete your local paintings.
We may update these terms when the app or relevant requirements change and provide notice where appropriate. California law governs to the extent permitted by applicable law, without depriving consumers of mandatory protections where they live. If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. Questions about these terms may be sent to Tyche Ventures LLC at the support address above.
