Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Kids Meal Planner (the "App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not download or use the App. You must be at least 18 years old, or the age of legal majority where you live, to use the App. The App is intended for adult parents, guardians, and caregivers.

2. Description of Service

Kids Meal Planner is an iOS planning app for organizing child profiles, weekly meals, pantry items, shopping lists, and shareable meal-plan PDFs. Some features require an optional Premium subscription. The App is an organizational tool only and is not a substitute for professional medical, nutritional, dietary, or food-safety advice.

3. License

Subject to these Terms, Tyche Ventures LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. This license does not transfer ownership of the App or its protected content.

4. Premium subscriptions and purchases

The App offers optional monthly and yearly Premium subscriptions through Apple's App Store and StoreKit.

• Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends.
• Apple charges the Apple Account used for purchase and handles billing, renewal, cancellation, refunds, and introductory-offer eligibility under its terms.
• Current price, duration, renewal terms, and any eligible introductory offer appear in the App Store purchase sheet before confirmation.
• You can manage or cancel through iOS Settings → Apple Account → Subscriptions and can use Restore Purchases in the App for an eligible transaction.

Premium currently includes unlimited child profiles, ten neutral sample planning templates, full-week copying, PDF export and printing, and caregiver sharing through the iOS share sheet.

5. Optional Amazon affiliate links

The App may provide optional product-search links to Amazon. Those links open outside Kids Meal Planner and may include search terms and a Tyche Ventures affiliate tag. As an Amazon Associate, Tyche Ventures LLC earns from qualifying purchases. Affiliate links do not increase the price charged by Amazon, and you are not required to open a link or purchase anything.

6. User content, local data, backups, and exports

App-entered planning content—including child profiles, meal plans, shopping lists, pantry items, notes, and selected photos—is stored in the App's local container by default. We do not operate a Kids Meal Planner account, cloud database, cloud-sync service, or remote recovery service for that content.

Apple-managed device or computer backup settings may create copies. PDFs, images, messages, emails, printouts, and other files you export or share are controlled by their destination and recipient after they leave the App. Uninstalling the App removes its local container from that device but does not remove copies in backups or external destinations.

You are responsible for appropriate device security, backups, reviewing exports, and recipient choices. We are not responsible for data loss resulting from device failure, App deletion, backup behavior, a recipient's actions, or another cause.

With your permission, the App can use the camera to scan a barcode and can use the camera or photo library for images you choose to add. Selected images stay with local App data. Barcode lookup sends the decoded barcode—not a camera frame, profile, or meal plan—to Open Food Facts.

7. Acceptable Use

You agree to use the App only for its intended household-planning purpose. You may not: (a) reverse-engineer, decompile, disassemble, or attempt to extract source code except where applicable law expressly permits it; (b) modify, adapt, or create derivative works based on the App except where permitted by law; (c) distribute, license, sell, or transfer the App in violation of these Terms or Apple's Usage Rules; or (d) use the App for an unlawful purpose.

9. General disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP OR THIRD-PARTY INFORMATION WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETE, CURRENT, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TYCHE VENTURES LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO USE OF OR INABILITY TO USE THE APP, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE 12 MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS ($50), WHICHEVER IS GREATER.

WITHOUT LIMITING THE FOREGOING, WE WILL NOT BE LIABLE FOR DAMAGES ARISING FROM ALLERGIC REACTIONS OR OTHER ADVERSE EFFECTS, INACCURATE OR INCOMPLETE THIRD-PARTY PRODUCT INFORMATION, LOST LOCAL OR EXPORTED DATA, OR DECISIONS MADE USING THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless Tyche Ventures LLC and its officers, directors, employees, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to: (a) your use of the App; (b) your violation of these Terms; (c) your violation of a third party's rights; or (d) meal-planning decisions made using the App.

12. Dispute resolution and arbitration

PLEASE READ THIS SECTION CAREFULLY—IT AFFECTS YOUR LEGAL RIGHTS.

You and Tyche Ventures LLC agree that disputes, claims, or controversies arising from or related to these Terms or the App will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.

CLASS ACTION WAIVER: YOU AND TYCHE VENTURES LLC AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules and will take place in Napa County, California, or another mutually agreed location. The arbitrator's decision will be final and binding, subject to applicable law.

13. Governing law

These Terms are governed by California law, without regard to conflict-of-law provisions. To the extent a lawsuit or court proceeding is permitted, you and Tyche Ventures LLC agree to the personal jurisdiction of the state and federal courts located in Napa County, California.

14. Intellectual property

Except for information and files you add and third-party materials, the App's software, design, Tyche Ventures-authored text, graphics, logos, and icons are owned by Tyche Ventures LLC and protected by intellectual-property laws. You retain your rights in content you add. Open Food Facts records and images, Apple materials, Amazon materials, and other third-party content remain owned by or licensed from their respective owners.

If a third party claims that the App or your possession and use of it infringes intellectual-property rights, Tyche Ventures LLC, not Apple, will be responsible for the investigation, defense, settlement, and discharge of that claim as required by applicable law.

15. Maintenance and support

Tyche Ventures LLC is responsible for maintenance and support services it chooses or is required to provide for the App. Apple has no obligation to provide maintenance or support. Contact us using Section 27 below.

16. Product claims

Tyche Ventures LLC, not Apple, is responsible for addressing claims relating to the App or its possession and use, including product-liability claims, claims that the App does not conform to an applicable legal or regulatory requirement, and claims under consumer-protection, privacy, or similar laws.

17. Legal compliance

You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country and are not listed on a U.S. Government list of prohibited or restricted parties.

18. Third-party services and terms

You must comply with applicable third-party terms when using the App, including wireless-data terms, Apple's Usage Rules, Open Food Facts terms, Amazon terms, and terms of any destination you choose through the iOS share sheet.

Open Food Facts receives the barcode and ordinary network metadata when you choose barcode lookup. Apple receives StoreKit purchase and entitlement communications. Amazon receives requests when you choose to open an optional affiliate link. Export and sharing destinations receive information only when you choose them. Each third party controls its service, availability, retention, and privacy practices.

19. Apple-specific terms

You acknowledge that: (a) these Terms are between you and Tyche Ventures LLC, not Apple Inc. ("Apple"); (b) Apple has no obligation to furnish maintenance or support; (c) if the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price, if any, and to the maximum extent permitted by law Apple has no other warranty obligation; (d) Apple is not responsible for addressing claims relating to the App; and (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.

20. Open Food Facts data and licenses

Kids Meal Planner uses Open Food Facts for user-initiated packaged-food barcode lookup. Community-contributed results can be incomplete, outdated, unavailable, or inaccurate. You must verify the physical package label and should not rely on the App or Open Food Facts to make allergy, nutrition, medical, or food-safety decisions.

Open Food Facts database content is available under the Open Database License 1.0 (ODbL); individual database contents use the Database Contents License 1.0 (DbCL); product images are available under CC BY-SA 3.0 and may also contain third-party trademarks or packaging artwork. 21. Force majeure

Tyche Ventures LLC will not be liable for a failure or delay caused by circumstances beyond its reasonable control, including natural disasters, government action, internet or telecommunications failures, power outages, or pandemics.

22. Children's privacy

The App is designed for adult parents, guardians, and caregivers and is not directed to children. See the Privacy Policy for information about local planning content, information an adult may choose to enter about a child, and third-party services.

23. Termination

Tyche Ventures LLC may discontinue future distribution, updates, or support for the App. We may terminate the license granted by these Terms if you materially breach them, subject to applicable law. Kids Meal Planner does not use a developer-operated account or remote access-control service, so termination concerns your license to use the App rather than suspension or deletion of a remote account.

Upon valid termination of your license, you must stop using the App. Provisions that by their nature should survive will survive, including disclaimers, limitations of liability, indemnification, intellectual-property terms, and dispute resolution.

24. Severability

If a provision is found unenforceable or invalid, it will be limited or eliminated to the minimum extent necessary, and the remaining Terms will continue in effect.

25. Entire agreement

These Terms, together with the Privacy Policy, form the entire agreement between you and Tyche Ventures LLC regarding the App and supersede prior agreements about that subject.

26. Changes to these Terms

We may update these Terms from time to time. We will change the effective date above and provide additional notice when appropriate. Continued use after updated Terms take effect constitutes acceptance. If you do not agree to an update, stop using the App.
