Terms of Use

1. Eligibility and authority

SetHarbor is designed for business operations and is not directed to children. You must have legal capacity to accept these Terms. If applicable law requires a parent, guardian, employer, or other authorized representative to accept for you, that person or organization must do so before you use the App. If you use SetHarbor for a business or other organization, you represent that you are authorized to accept these Terms for that organization. In that case, "you" includes the organization.

2. Limited license

Subject to these Terms and Apple's Usage Rules, Tyche Ventures grants you a limited, personal or internal-business, non-exclusive, non-transferable, revocable license to use SetHarbor on Apple-branded devices you own or control. The App is licensed, not sold.

You may not copy, distribute, rent, lease, sell, sublicense, reverse engineer, bypass technical limits, interfere with security, use the App to violate law or another person's rights, or misrepresent SetHarbor as your own product, except where applicable law does not allow a restriction.

3. What SetHarbor does

SetHarbor is a local-first operational tool for staging inventory. It can help you create properties and rooms, reserve exact pieces, guide pull, load, install, destage, return, move, receive, and audit work, record location and condition, review exceptions and movement history, and initiate an inventory CSV export.

SetHarbor's first release is not a CRM, invoicing platform, cloud team-sync service, AI cataloging system, or RFID system. Tyche Ventures may add, change, suspend, or remove features in a future release, subject to applicable law. A website description does not guarantee that a future feature will be released.

4. Evaluation allowance

SetHarbor's evaluation has no time limit and permits one active project and up to 100 active inventory records. The allowance applies to active operational scale, not to a fixed number of days.

The App may prevent net-new expansion above those active limits unless Studio is active. You may continue to open and review existing records, complete active work, address exceptions, export supported inventory data, delete records, review billing status, manage the subscription, and restore purchases.

5. Optional Studio subscription

Studio unlocks additional active projects and active inventory records. Monthly and yearly subscription options may be offered through Apple StoreKit. The App's Apple purchase sheet is the controlling source for the price, currency, billing period, renewal price, introductory offer, and eligibility presented to your Apple Account before purchase.

If Studio expires, is canceled, or cannot be verified, SetHarbor preserves access to existing records and active work but can block new expansion above the evaluation allowance until a valid Studio entitlement is available. Studio is intended for the purchasing Apple Account and is not offered through Family Sharing.

6. Billing, renewal, cancellation, and restoration

• Payment: Apple charges your Apple Account when you confirm a purchase.
• Auto-renewal: Unless canceled at least 24 hours before the end of the current subscription period, the subscription automatically renews. Apple may charge the account for renewal within 24 hours before the period ends at the renewal price Apple displays or otherwise communicates.
• Manage or cancel: Use the Manage Subscription control in SetHarbor or the subscription settings for your Apple Account. Removing the App from a device does not cancel the subscription.
• Restore Purchases: Use Restore Purchases in SetHarbor while signed in to the Apple Account that made the purchase. Restoration depends on a verified StoreKit entitlement.
• Offers: Apple determines introductory-offer eligibility and applicable terms. Unused portions of a free trial, if offered, may be forfeited when a subscription is purchased as Apple explains at checkout.
• Refunds: Apple handles billing and refund requests under its applicable policies and law.

7. Local records and continuity

SetHarbor does not require a Tyche account. Operational records are stored in the App's local container. You are responsible for device access, the accuracy and lawfulness of entries, internal procedures, and any files you export or share. Tyche Ventures generally cannot retrieve local records if they are deleted or become inaccessible.

The supported CSV feature exports inventory information when an owner initiates it. It is not a representation that every project, task, note, photo, exception, or history field will be included. Review the generated file before relying on it or sending it elsewhere.

8. Camera, photos, and internal labels

Camera and photo access are optional. Camera access can read an internal QR label; manual item-ID entry is available. A chosen photo can help identify a piece. You are responsible for having permission to capture and store images and for ensuring a label does not expose sensitive information to someone who can see it.

9. Operational responsibility

SetHarbor is an organizational aid. It does not physically verify an item's identity, location, ownership, availability, load security, condition, or safe handling. Scans, manual entries, reservations, routes, and status changes can be incomplete or wrong. Your personnel must inspect pieces, verify labels and locations, follow property-access rules, use appropriate handling and transportation practices, and resolve conflicts before acting.

Do not use SetHarbor as the sole control for keys, alarm codes, life-safety information, regulated goods, or any operation where an app error or unavailable device could cause injury, property damage, legal noncompliance, or material loss.

10. Confidential and personal information

You decide what to enter. Use only information you are authorized to store, photograph, export, and share. Limit property access notes and other confidential details to what is operationally necessary, secure the device, and choose export recipients carefully. You are responsible for notices, permissions, and agreements required for information about customers, workers, vendors, properties, or inventory.

11. Your content and our intellectual property

You retain rights in the records and photos you lawfully enter. You grant Tyche Ventures no general right to use local workspace content merely because it is stored in SetHarbor. If you send content to support, you grant us a limited right to use it to respond, investigate, secure, and improve the App.

SetHarbor, its code, design, text, graphics, trademarks, and other Tyche Ventures materials are owned by Tyche Ventures or its licensors and are protected by intellectual-property laws. These Terms do not transfer those rights to you.

12. Feedback

If you voluntarily provide suggestions that do not include confidential information, you grant Tyche Ventures a worldwide, perpetual, irrevocable, royalty-free right to use them without restriction or compensation. You are not required to provide feedback.

13. Updates, availability, and support

Tyche Ventures may release updates and may discontinue future distribution or support, subject to applicable law. App availability can depend on Apple, your device, operating-system version, storage, permissions, StoreKit, and network access for subscription operations. We do not guarantee uninterrupted or error-free operation.

Tyche Ventures is responsible for maintenance and support it chooses or is required to provide. Apple has no obligation to provide maintenance or support. Contact us through SetHarbor Support.

14. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SETHARBOR IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RESULTS. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYCHE VENTURES AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS, GOODWILL, USE, DATA, INVENTORY, OR OPPORTUNITY, ARISING FROM OR RELATED TO SETHARBOR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TYCHE VENTURES FOR ALL CLAIMS RELATING TO SETHARBOR WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR SETHARBOR DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR US$50. These limits do not apply where prohibited by law.

16. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tyche Ventures and its members, managers, employees, contractors, licensors, and affiliates from claims, damages, losses, liabilities, and expenses arising from your unlawful use of SetHarbor, your content, your exports or sharing, your violation of these Terms, or your infringement of another person's rights.

17. Product claims and intellectual-property claims

Tyche Ventures, not Apple, is responsible for addressing claims relating to SetHarbor or its possession and use, including product-liability, legal-compliance, consumer-protection, privacy, and intellectual-property-infringement claims, to the extent required by these Terms or applicable law.

18. Apple-specific terms

You acknowledge that these Terms are between you and Tyche Ventures, not Apple Inc. ("Apple"). Apple has no obligation to furnish maintenance or support. If SetHarbor fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you upon your acceptance.

19. Legal compliance and export controls

You must comply with applicable laws, Apple's Usage Rules, wireless-data terms, and the terms of any destination you choose through the system share sheet. You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country and are not listed on a U.S. Government list of prohibited or restricted parties.

20. Termination

Tyche Ventures may terminate the license granted by these Terms if you materially breach them, subject to applicable law. Because SetHarbor does not use a Tyche account or remote access-control service, termination concerns the license to use the App rather than deletion of a remote Tyche workspace. Upon valid termination, you must stop using SetHarbor.

Provisions that by their nature should survive will survive, including ownership, feedback, disclaimers, liability limits, indemnification, and dispute terms.

21. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except to the extent another law must apply. State and federal courts located in California will have exclusive jurisdiction over disputes, unless applicable consumer law gives you the right to bring a claim elsewhere.

22. General terms

If any provision is invalid or unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, acquisition, reorganization, or asset transfer. We are not responsible for delay caused by events beyond our reasonable control.

These Terms and the Privacy Policy form the entire agreement about SetHarbor and supersede prior agreements about that subject.

23. Changes to these Terms

We may update these Terms. We will change the effective date and provide additional notice when appropriate. Continued use after updated Terms take effect constitutes acceptance where permitted by law. If you do not agree to an update, stop using SetHarbor.
