Tyche Ventures LLC — All Applications
Effective Date: March 17, 2026
By downloading, installing, or using any application developed by Tyche Ventures LLC (each an "App," collectively the "Apps"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use our Apps. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use our Apps. Our Apps are intended for use by parents, guardians, caregivers, and homeowners.
Tyche Ventures LLC develops iOS applications for families, including but not limited to meal planning, daily routine management, ingredient scanning, home maintenance tracking, and related organizational tools. Our Apps are planning and organizational tools only and are not substitutes for professional medical, nutritional, safety, or any other professional advice.
Subject to these Terms, Tyche Ventures LLC grants you a limited, non-exclusive, non-transferable, revocable license to use our Apps on any Apple-branded device that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use our Apps on any device you do not own or control.
Our Apps may offer optional in-app subscriptions ("Premium") via Apple's App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Payment is charged to your Apple ID account. You can manage or cancel subscriptions in your device's Settings → Apple ID → Subscriptions. Prices are set by us but may vary by region and are subject to change. Any price changes will apply to the next billing cycle after notice.
Some Apps may contain links to products on Amazon.com or other retail websites. As an Amazon Associate, Tyche Ventures LLC earns from qualifying purchases. These links do not affect the price you pay. You are not obligated to purchase any products through these links.
All data you create in our Apps (profiles, plans, schedules, tasks, photos, documents, and any other content) is stored locally on your device. We have no access to your data. You are solely responsible for maintaining backups of your data. We are not responsible for any loss of data resulting from device failure, App deletion, or any other cause.
You agree to use our Apps only for their intended purposes. You may not: (a) reverse-engineer, decompile, disassemble, or attempt to extract the source code of any App; (b) modify, adapt, or create derivative works based on any App; (c) distribute, license, sell, or otherwise transfer any App to any third party; (d) use any App for any unlawful purpose.
OUR APPS DO NOT PROVIDE MEDICAL, NUTRITIONAL, SAFETY, OR ANY OTHER PROFESSIONAL ADVICE. Our Apps are planning and organizational tools only. They do not verify food safety, nutritional completeness, ingredient safety, structural safety, or any other health or safety considerations. Suggestions, templates, and information provided by our Apps are for organizational convenience only and are not reviewed by licensed professionals. Users are solely responsible for: verifying the safety and accuracy of any information used in connection with our Apps; consulting qualified healthcare professionals, nutritionists, contractors, or other experts as appropriate; reading product labels and verifying ingredients; making informed decisions regarding the health, safety, and well-being of themselves and their families.
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF OUR APPS IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TYCHE VENTURES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OUR APPS, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO OUR APPS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) ADVERSE HEALTH EFFECTS, ALLERGIC REACTIONS, OR INJURIES RELATED TO ANY PLANS, SCHEDULES, OR INFORMATION CREATED USING OUR APPS; (B) INACCURATE OR INCOMPLETE INFORMATION FROM THIRD-PARTY DATABASES OR SERVICES; (C) DECISIONS MADE BASED ON INFORMATION PROVIDED BY OUR APPS; (D) PROPERTY DAMAGE OR MAINTENANCE FAILURES RELATED TO INFORMATION TRACKED IN OUR APPS.
You agree to indemnify, defend, and hold harmless Tyche Ventures LLC, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our Apps; (b) your violation of these Terms; (c) your violation of any rights of any third party; (d) any decisions or actions taken based on information in our Apps.
PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.
You and Tyche Ventures LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or our Apps ("Dispute") will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual action in small claims court if the claim qualifies.
CLASS ACTION WAIVER: YOU AND TYCHE VENTURES LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Napa County, California, or at another mutually agreed location. The arbitrator's decision shall be final and binding.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. To the extent that any lawsuit or court proceeding is permitted hereunder, you and Tyche Ventures LLC agree to submit to the exclusive personal jurisdiction of the state and federal courts located in Napa County, California.
Our Apps and all content, features, and functionality (including but not limited to design, text, graphics, logos, icons, and software) are owned by Tyche Ventures LLC and are protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Apps. In the event of any third-party claim that an App or your possession and use of an App infringes that third party's intellectual property rights, Tyche Ventures LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Tyche Ventures LLC is solely responsible for providing any maintenance and support services with respect to our Apps. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to our Apps. For support inquiries, please contact us at the address provided in Section 26 below.
You acknowledge that Tyche Ventures LLC, not Apple, is responsible for addressing any claims by you or any third party relating to our Apps or your possession and/or use of our Apps, including but not limited to: (i) product liability claims; (ii) any claim that an App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using our Apps. This includes, but is not limited to, your wireless data service agreement, Apple's Usage Rules as set forth in the Apple Media Services Terms and Conditions, and any applicable terms of service for third-party services accessed through our Apps.
You acknowledge and agree that: (a) these Terms are between you and Tyche Ventures LLC only, and not with Apple Inc. ("Apple"); (b) Apple has no obligation to furnish any maintenance and support services with respect to our Apps; (c) in the event of any failure of an App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App — to the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Tyche Ventures LLC's sole responsibility; (d) Apple is not responsible for addressing any claims relating to our Apps; (e) Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
Tyche Ventures LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, or pandemics.
Our Apps are designed for use by parents and guardians who are at least 18 years of age. Please refer to our Privacy Policy and the app-specific privacy policies for details on data handling and COPPA compliance.
We may terminate or suspend your access to our Apps at any time, without prior notice, for any reason, including if you breach these Terms. Upon termination, your license to use our Apps will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including disclaimers, limitations of liability, indemnification, and dispute resolution.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
These Terms, together with our Privacy Policy and any app-specific terms, constitute the entire agreement between you and Tyche Ventures LLC regarding your use of our Apps and supersede any prior agreements.
We may update these Terms from time to time. We will notify you of material changes by updating the "Effective Date" at the top of this page. Your continued use of our Apps after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using our Apps.
